How much NOT having digital time tracking costs you

Between fines, untracked overtime and time wasted in Excel, not having digital time tracking is costing you more than you think.

Many restaurant owners think a digital time tracking system is an unnecessary expense. "I get by with Excel", "my employees clock in on paper", "I keep it all in my head". Until an inspection arrives, an employee claims unpaid overtime, or they simply realise they have been paying for hours nobody works for months.

In this article we are going to put real numbers on what NOT having digital time tracking costs in hospitality — under Spanish rules. Spoiler: it is far more expensive than any tool on the market.

Cost 1: fines from the Spanish Labour Inspectorate

Since 2019, keeping working time records has been mandatory for every company in Spain. The Spanish Labour Inspectorate can turn up unannounced and ask for the records of the last 4 years. If you do not have them, or the ones you have are not reliable (sheets filled in afterwards, edited spreadsheets), you face:

  • Serious infringement: from €751 to €7,500 per infringement.
  • Multiple infringements: one for each employee without records, one for each irregularity detected.
  • Repeat offences: if you have been sanctioned before, the fines move up a grade.
  • Extreme case: very serious infringements for overtime fraud can reach €187,515.

A restaurant with 10 employees and no working time records can easily receive a penalty of €7,500 to €15,000 in a single inspection. Compare that with the €29 a month a digital tool costs.

Cost 2: untracked overtime

This is probably the biggest hidden cost. If you do not have a system that automatically compares clocked hours with contract hours, you do not know how much overtime is being generated.

Let's do a simple calculation:

  • An employee works 15 minutes of overtime every day without anyone recording it.
  • That is 1.25 hours of overtime a week.
  • That is 5 hours of overtime a month.
  • That is 60 hours of overtime a year.
  • At an average cost of €12/hour with the 75% premium, that is €21/hour.
  • Total: €1,260 a year per employee.

With 8 employees, we are talking about more than €10,000 a year in invisible overtime. Which, on top of that, if the employee claims it in court, you will have to pay with interest and without being able to prove those hours were never worked.

Cost 3: invisible absenteeism

The other side of the coin. Without digital clock-ins, you do not just lose money on untracked overtime — you also lose it on hours that are paid but never worked.

  • Employees who systematically arrive 10 minutes late.
  • Breaks that stretch beyond what was agreed.
  • Early departures on Fridays.

10 minutes a day per employee is 3.3 hours a month. With 8 employees, that is 26 hours a month that you pay for but nobody works. At €10/hour, that is €260 a month slipping away without you noticing. €3,120 a year.

This is not about distrusting your team. It is about having objective data. When everyone knows there is a reliable record, the extra 10 minutes — in both directions — disappear on their own.

Cost 4: your time as an owner

How much time do you spend every week managing schedules, rotas and clock-ins?

  • Designing the week's rota: 30-60 minutes.
  • Communicating changes over WhatsApp and handling replies: 20-30 minutes.
  • Reviewing attendance and punctuality: 15-20 minutes.
  • Preparing data for your payroll advisor at the end of the month: 1-2 hours.
  • Resolving conflicts caused by schedule misunderstandings: variable.

Adding it all up, we are talking about 3 to 5 hours a week. If your time as an owner is worth €30 an hour (and it is probably worth more), that is between €400 and €650 a month in admin time. Time you could spend on what actually makes your business grow: being on the floor, improving the menu, finding new suppliers or simply resting.

Cost 5: risk in employment lawsuits

When an employee sues over unpaid overtime and you have no reliable working time records, Spanish case law is clear: the burden of proof falls on the employer.

In other words: if you cannot prove the hours worked with an immutable, detailed record, the judge will tend to believe the worker's version. And claims usually cover the last 12 months, with interest.

An overtime lawsuit can mean:

  • Employment lawyer: €1,500-3,000.
  • Overtime claimed: €2,000-8,000.
  • Back-dated contributions to the Spanish Social Security.
  • A possible additional penalty from the Labour Inspectorate if the lawsuit uncovers irregularities.

The ROI of a digital tool

Let's put the numbers in perspective for a restaurant with 10 employees:

  • Cost of the tool: €29/month = €348/year.
  • Savings in avoided fines: from €751 to €15,000+.
  • Savings in untracked overtime: estimated €5,000-10,000/year.
  • Savings in invisible absenteeism: estimated €3,000/year.
  • Savings in the owner's time: estimated €5,000+/year.
  • Savings in legal risk: incalculable, but potentially thousands of euros.

Even being conservative, the return on investment is more than 30 times the cost of the tool. And that is without counting the peace of mind of knowing that, faced with any inspection or claim, you have a reliable record you can export in 30 seconds.

So why do we stick with Excel?

The honest answer is inertia. "We have always done it this way" is the silent enemy of profitability in hospitality. Excel works... until it stops working. And when it stops working, it is usually because the Labour Inspectorate has knocked on your door or an employee has gone to court.
